V9 Events & Rentals

General rental terms

These general rental terms (CGL) and the contract signed online form the agreement between V9 Events and the customer. In case of conflict, the signed contract prevails over commercial website copy. The French version is authoritative.

Article 1 — Parties

This contract is entered into between V9 Events, Auto-entrepreneur (micro-entreprise), whose registered office is at 3 rue du Jura, 68128 Village-Neuf, France (the “Lessor”), and the customer identified in the summary (the “Lessee”). Where the Lessee acts for non-professional purposes, they benefit from the mandatory provisions of the French Consumer Code.

Article 2 — Subject matter

The Lessor lets to the Lessee the movable goods listed in the summary (event equipment, tableware, machines, décor items), solely for the festive, event or professional use declared. Any other use, sub-letting, lending or making available to a third party is prohibited without the Lessor’s prior written consent (French Civil Code, art. 1719 et seq.).

Article 3 — Term — handover dates

The hire runs from the start date to the end date in the summary, both inclusive. Start and end dates must be business days (Monday–Friday). A weekend hire is possible only Friday to Monday inclusive and is billed as two (2) days. The Lessee may not keep the goods beyond the end date without written consent; any delay is unlawful occupation and may give rise to extra charges and a deposit deduction.

Article 4 — Price, payment and VAT

Prices are stated and payable exclusively in euros. Any amounts in Swiss francs (CHF) are indicative only. VAT not applicable, article 293 B of the French Tax Code (CGI). The balance of hire, delivery and setup is due as agreed. The Lessor applies no seasonal surcharge.

Article 5 — Deposit (security)

A deposit is required, as shown in the summary. It is payable in cash or by cheque at handover. It is not an advance on rent. It is cashed only in case of damage, loss, theft, abnormal soiling, non-return or restoration costs. After the contradictory return inspection, any unused balance is refunded. The Lessor may retain all or part of the deposit up to the loss, without prejudice to further damages if the loss exceeds the deposit (French Civil Code, art. 1231-1 et seq.).

Article 6 — Delivery, pickup and border formalities

On-site pickup at 3 rue du Jura, 68128 Village-Neuf (Saint-Louis area) is free. Delivery/collection is charged according to the chosen zone. The Lessee must provide reasonable access, parking and a time slot. For delivery to Switzerland, customs formalities (temporary admission / ATA carnet) may apply; they are borne by the Lessee unless otherwise agreed in writing. The Lessee shall provide the necessary information and comply with lead times.

Article 7 — Setup and teardown

Setup, setup + teardown or Premium packages are optional. They do not transfer ownership. The Lessee prepares the venue (access, power, safety, site permits). Undeclared constraints (stairs without lift, night hours, listed buildings, etc.) may lead to a surcharge or refusal to intervene.

Article 8 — Contradictory condition report

A digital condition report (photographs and comments) is drawn up at handover and return. The Lessee has four (4) hours after handover to report in writing (email or booking thread) any non-apparent defect. Failing that, the goods are deemed handed over in good working and clean condition, except for hidden defects. The return report is authoritative for the deposit.

Article 9 — Lessee’s duties — custody and use

From handover, the Lessee has legal custody of the goods (French Civil Code, art. 1242). They shall use them according to their purpose and the safety notices. It is forbidden to alter, dismantle, paint, stick, overload or expose the goods to weather without suitable protection. Machines (bubbles, smoke, ice, beer tap) must be used by an adult, as per the manuals. The Lessee is liable for staff, guests and contractors.

Article 10 — Cleaning and return

Goods must be returned on the agreed date, complete, working, clean and dry: tableware and cutlery cleared, rinsed, free of food residue and labels; linens not irreversibly stained; chafing dishes emptied and wiped; machines drained, unplugged, cooled; glassware unchipped. Normal use cleaning is included. Abnormal dirt, persistent stains, mould, baked-in grease or required dismantling give rise to restoration fees, deductible from the deposit (minimum lump sum equivalent to €25 excl. VAT, according to time actually spent).

Article 11 — Breakage, loss, theft and deterioration

Any breakage, loss, theft or deterioration, even accidental, is borne by the Lessee. Replacement is at the new-for-old value of an equivalent item, less ordinary wear where applicable. The Lessee shall report any incident to the Lessor immediately and, in case of theft, file a police report and send the receipt. The Lessor is not required to supply emergency replacement goods.

Article 12 — Lessor’s liability

The Lessor delivers goods that are fit for purpose (French Civil Code, art. 1719). Liability cannot be engaged for non-conforming use, lack of care by the Lessee, force majeure, or indirect loss (business loss, reputational harm, a ruined event) except for wilful or grossly negligent misconduct. Electrical equipment must be connected to a compliant installation. The Lessee checks that the goods suit the event.

Article 13 — Insurance

The Lessee is advised to check that home, professional or event insurance covers hired goods (breakage, theft, third-party liability). Failing that, the Lessee remains personally liable. The Lessor may request an insurance certificate for large volumes.

Article 14 — Cancellation, amendment and withdrawal

Online cancellation until the day before start: free if ≥ 14 days before start; 30% of the hire amount between 14 and 7 days; 50% under 7 days. Delivery or setup fees already incurred may remain due. Dates or contents may be changed until the day before, subject to stock. Under article L. 221-28 of the French Consumer Code, the 14-day right of withdrawal does not apply to leisure services to be provided on a specific date or period, nor to goods made to the consumer’s specifications where those exceptions apply. This contract is a hire for fixed dates.

Article 15 — Personal data (GDPR)

Data (identity, contact details, delivery address, signature, hire history) are processed by V9 Events as controller, to perform the contract, invoice, track deposits and meet legal duties (GDPR art. 6.1.b and 6.1.c). They are kept for the relationship then the applicable limitation period (generally 5 years; 10 years for accounting records). The Lessee has rights of access, rectification, erasure, restriction, objection and portability, and may lodge a complaint with the CNIL. Contact: hello@v9-events.com. No sale of data. Details: the site privacy policy.

Article 16 — Electronic signature

The electronic signature on this contract, together with the ticked acceptance boxes and the timestamp, constitutes consent under articles 1366 and 1367 of the French Civil Code and the eIDAS Regulation. It has the same evidential value as a handwritten signature between the parties. The Lessee acknowledges having been able to read the entire contract before signing.

Article 17 — Governing law — disputes

The contract is governed by French law. In case of dispute, an amicable solution is sought. A consumer may use a free consumer mediator under articles L. 611-1 et seq. of the French Consumer Code, after a prior written complaint. Failing agreement, French courts have jurisdiction; the consumer may also bring proceedings before the courts of their domicile.

Article 18 — Language of the contract

This contract is drawn up in French, the official language. An English or German translation may be provided to assist reading. In the event of any discrepancy in interpretation between versions, the French version alone shall prevail.

Article 19 — General provisions

If a clause is deemed unwritten or void, the others remain. These terms, the order summary and the T&Cs form the contract. In case of conflict, this contract prevails over commercial website copy. Any amendment requires writing (including email or the booking thread).

Article 20 — Formation of the contract and confirmation

The online request holds stock provisionally. The contract becomes binding only after the Lessee's electronic signature and the Lessor's confirmation, as a rule within forty-eight (48) business hours. If declined, stock is released and no hire fee is due. Delivery or setup costs already incurred with the Lessee's agreement may remain payable.

Article 21 — Payment terms

Hire, delivery and setup are payable in euros, by bank transfer to the details on the invoice or by another means agreed in writing. The deposit is not an advance on rent: it is handed over in cash or by cheque at handover. The Lessor may make delivery or pickup subject to payment of the agreed balance. Late payment may suspend performance.

Article 22 — Absence, missed slot and no-show

The Lessee shall be present, or send an identified representative, at the agreed slot. Failure to give at least four (4) hours' notice may result in the trip being charged, handover being postponed, or termination under the cancellation terms of article 14. Equipment not collected on the start date remains payable under the cancellation scale.

Article 23 — Force majeure

Force majeure means unforeseeable, irresistible events beyond a party's control under French law (extreme weather, official ban, border closure, epidemic, major network failure, etc.). Obligations are suspended while the event lasts. The parties shall in good faith seek to postpone the dates. If postponement is impossible, the contract may be ended without a hire penalty; irrecoverable costs already incurred remain due.

Article 24 — Consumer mediation

Under articles L. 611-1 and L. 616-1 of the French Consumer Code, a consumer may use a free consumer mediator. First step: written complaint to hello@v9-events.com. If the reply is not satisfactory within thirty (30) days, the consumer may refer the matter to a mediator listed by the CECMC (economie.gouv.fr / mediation-conso). V9 Events will publish the name and details of the mediator it joins as soon as membership is effective. European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
